Employee Lacerates Palm with Circular Saw

At approximately 10:00 a.m. on June 8, 2004, an employee, a masonry helper, was assisting masonry workers who built forms to pour concrete for landscape gardens. His foreman asked him to cut a piece of bend board. The employer had not trained the employee in circular saw operation because the employer did not allow helpers, such as the employee, to operate circular saws. While the employee was holding the bend board with his left hand, he was cutting with the saw in his right hand. Other than one end of the bend board touching the ground, the rest of the board was held in the air without being secured to a surface. As he was cutting, his lacerated the palm and tendons in his left hand. The circular saw, manufactured by Bosch with the Model of 1677 M, was a 7.25-in. worm drive.
