Employee injured during trench collapse

At approximately 3:30 p.m. on January 29, 2004, Employee #1, a laborer, was working for a general contractor at a construction site for a commercial building. The employer and Employee #1 were digging in a trench. When they reached a depth of 4.5 feet, the employer and Employee #1 got out of the trench. Employee #1 was instructed to clean up the nearby sidewalk of debris to not impede pedestrian traffic and safety. As he was cleaning up the sidewalk, a plumber, who was a subcontractor at the site, instructed another coworker to dig a little more by the building. The coworker followed the plumber's instruction and went to dig near the building side of the excavation. Meanwhile, Employee #1 was located on the curb side of the excavation. For some reason, a part of the concrete sidewalk, measuring approximately 18-inches long by 18-inches wide by 3.5-inches thick, collapsed and fell on Employee #1. His left leg was pinned. The coworker yelled for help and emergency services were contacted. Employee #1 was hospitalized at St. Mary's Hospital and treated for a broken left leg, which required surgery.
