Employee's Leg Is Fractured in Fall from Deck

On November 3, 2009, Employee #1 was installing sheet metal flashing and underlayment around the second story deck privacy wall at a single family residence being constructed. The privacy wall was 27-in. wide and was 44-in. above the floor of the deck and 20 ft 8-in. above the ground. Employee #1 stepped onto the privacy wall when he stepped off the stepladder to take a measurement of the ledge in front of the fireplace. He stepped off the ladder and slipped on the flashing. He fell to the ground and sustained a fractured right tibia and fibula that required hospitalization for surgery. Fall protection equipment was available on the job site, but Employee #1 was not using any protection.
