Employee's leg fractured after being struck by forklift fork

At approximately 10:30 p.m. on March 6, 2003, Employee #1 was working for a baby furniture distribution warehouse operating a reach-in type forklift, CROWN-3B, model number RD5200. The employee was going to pick up merchandise from aisle number 28 of the facility when the forklift backed into another stationary reach-in type forklift. One of the forks entered the driver's compartment of the moving forklift, pinning the employee's right leg between the driver's compartment wall and the fork. Employee #1 fractured his right lower leg and was taken to San Antonio Community Hospital in Upland, California, where he underwent surgery and was hospitalized.
