Employee's thumb and finger amputated by mitre saw

At approximately 10:30 a.m. on August 9, 2002, Employee #1, a general laborer, was using a Black and Decker power miter saw, Model Number 7115, to cut wood on the metal bed of a flat bed truck. The saw was not secured to the bed of the truck that was being used as his work surface. The saw moved unexpectedly and Employee #1's left thumb and little finger struck the rotating saw blade and were amputated. The employer drove Employee #1 to the hospital for emergency medical care. Employee #1 was subsequently airlifted to another hospital for surgery, but attempts to reattach his fingers were not successful.
