Investigation Summary
At approximately 8:00 a.m. on June 7, 2002, Employee #1 of Merchant Metals was working with five other coworkers in the shipping dock. A lead person was assisting the employees set the panels on the frame. The employees were loading a shipping pallet with panel fencing for overseas shipment to Pearl Harbor, HI. To ship the panels overseas, the panels were required to fit into a shipping container. With limited space in the container, the employer developed a steel frame shipping pallet to hold 40 panels vertically. A new process was put in place where by two employees were assigned to secure the panels vertically on the shipping pallet. The remaining employees applied cardboard spacers and stood up each panel successively on the shipping pallet adjacent to the remaining vertical panels. After the twenty-third or twenty-fourth panel, the two employees assigned to hold the panels found that they could no longer hold the load and the panels fell towards remaining employees. Employee #1 could not move away from the falling panels quickly enough and was trapped underneath the fallen panels. The remaining employees lifted the panels off Employee #1. Employee #1 was transported and treated at Holy Cross Medical Center. Employee #1 was hospitalized for 3 days. Employee #1 sustained fractured left knee and a fractured L4 transverse process (lower spine).
