Employee's finger amputated when no guard on machine

At approximately 2:00 p.m. on December 14, 2000, Employee #1 was operating a vertical log splitter with a 3-ft blade. The log splitter had a handle to operate it 4 ft away from the center of the blade when the blade was down. Employee #1 used his right hand to hold the log in place while pulling on the handle to operate the log splitter with the left hand. Employee #1 had a glove on and got his finger caught between the blade and the top of the log being split. Employee #1 amputated his right index finger to the first joint. There was no guard on the machine and no device to prevent the hand from being in the point of operation. At the time of the accident, Employee #1 was working alone. The employer had left the area for a short time.
