Investigation Summary
On June 12, 2003, Employee #1 entered a confined space, a cistern system, to patch up cement cracks with a sealant. A case was opened with the property owner to investigate the accident. There does not appear to be an employer and employee relationship at this time. There was significant Media interest, but no Cal/OSHA jurisdiction, as this was a landlord and tenant issue. Employee #1 was overcome by vapors, fell into the water, and was found drowned. The Sheriff's Dive Team recovered the body, with assistance from two Fire Departments. Employee #1's son also enter the cistern and was overcome by the vapors, but he was rescued.
