Investigation Summary
At 2:27 a.m. on November 10, 2001, Employee #1, an inspector, with Total Employee Management Co.(TEMCO) located in Los Angeles, CA, was on duty when he was struck by a semi-trailer truck. TEMCO is an incorporated company contracted by Burlington Northern Santa Fe Railway to inspect semi-trailer trucks and record shipping information. Employee #1 was at lane number four of the facilities checkpoint in-gate when a Peterbilt semi-trailer truck approached. The truck did not have a trailer attached and was not supposed to be in the in-gate of the facility. A safety zone where employees walk to inspect all areas around the incoming trucks was clearly marked with yellow hash marks. The truck lane itself was surrounded by the inspection zone and was also clearly marked with "STOP" painted on the asphalt, a limit line, and a posted stop sign. The truck driver drove into the terminal and did not stop as indicated, proceeded past the inspection zone, and completely blocked it. The truck driver exited the vehicle and walked to the south-most booth in order to check the list of incoming bare chassis being accepted and returned to his vehicle. Employee #1 exited the lane four booth to determine if the truck driver needed any assistance. Employee #1 walked in front of the truck and noticed that the truck driver had returned to the vehicle and evidently did not need any assistance, so he proceeded back to the booth. As Employee #1 was walking back to the booth, the truck driver started to drive forward knocking him to the ground and running over his left foot. Employee #1 was transported by emergency responders to Santa Marta Hospital located in East Los Angeles, CA, where he underwent surgery for a comminuted fracture to the left fibula and an avulsion fracture to the left tibia.
