Employee'S Finger Amputated While Using Unguarded Saw

On November 1, 2001, Employee #1, a temp from one of the four temp agencies contracted by the employer, was engaged in the manufacture of rubber stamps in varying sizes from 1.75 to 4.0 inches in length. The rubber stamps are glued onto pieces of wood that are cut in the company's cutting room, using a 10-inch contractors' table saw. Employee #1 was instructed to cut several pieces of wood at one time and to hold them with both hands, particularly with the right thumb and middle finger, clamping the pieces of wood together. During this process, the right forefinger was in the air, pointed in the direction of the blade. While he was cutting the wood, he was pushed backwards from the "kicking back" action of the wood that he was crosscutting, and his right forefinger contacted the unguarded saw blade, amputating his right forefinger. The employee was hospitalized. The causal factor of the accident was the failure of the employer to install a guard on the table saw and to train the employee.
