Employee Righ thumb is Lacerated and Partially Avulsioned

At approximately 11: 15 a.m. on August 30, 2001, Employee #1 was driving a side-loading refuse truck. Just prior to the accident, Employee #1 pushed the button to activate the packing cycle. The button is not a dead-man or maintain button. During the compaction phase of the cycle, the ram pushed a milk carton over the loading sill and onto the ground. As Employee #1 was bending down to pick up the carton, he steadied himself by resting his right hand on the loading sill. The ram was on its way back when it trapped his gloved thumb. During the packing cycle, the point-of-operation of the ram was not protected. Employee #1 received a partial avulsion and severe laceration of his right thumb when the ram of the compactor caught the thumb between the ram and a raised portion of the loading sill. The compaction and storage equipment mounted on the truck was manufactured by Stagg Equipment, Model SL-9, Serial Number SL1091218, manufactured October, 1991. The employee was taken to the hospital and treated for his injuries.
