Employee killed by falling clod of compacted soil

Employee #1 was on his way to inspect the hammer on a pile driver that was embedding some large steel pilings at a 25 ft by 25 ft benched excavation. He was walking by an intact set of nine approximately 16 ft high by 1 ft square concrete pilings that had been exposed during excavation activities. These old pilings were in a 3 by 3 configuration, spaced 2 ft apart from one another, and about 10 ft from the current pile driving activity. Compacted soil was still in place between them. Employee #1 was walking past the old pilings when a 1 ft by 2 ft by 4 ft chunk of compacted soil fall out from between them and struck him on the shoulder. He suffered multiple fractures and a fractured rib punctured his heart, killing him. The new hole was dug in cohesive, previously excavated soil. Although it had been benched, the benching dimensions were not as required by OSHA standards.
