Employee with COVID-19 infection dies

An employee was working as a receptionist and telephone operator at an outpatient care center. She scheduled patient appointments. She worked in an area in which direct patient care was not being provided. Since March 1, 2020, she had been on a work status covered by the Family Medical Leave Act (FMLA) for ongoing cancer treatment. Her employment status ended on March 31, 2021. She contracted COVID-19 from family members who were all positive. The employee was hospitalized on August 24, 2021. A representative of the emergency room (ER) stated that ER personnel were not notified that the employee had been hospitalized due to COVID-19. The employee, her husband, and a child were all hospitalized. None were vaccinated. The husband and child recovered. The employee died at 11:03 p.m. on September 11, 2021. The employer did not report the employee's hospitalization, but it did report the employee's death. The employer asked if this were a reportable event, when the COVID-19 was not contracted at work. This query was communicated to the CCAO AAD. CSHO was assigned to conduct an inspection per direction from the Regional Office. The employee was positive for both cancer and COVID-19. This was not an OSHA-covered fatality.
