Employee with COVID-19 infection dies

An employee was working as a correctional officer for a firm that housed people who had crossed the border from Mexico into the United States. The employer operated a detention facility in which were housed detainees from ICE, US Marshalls, and other agencies. At approximately 2:00 p.m. on April 23, 2021, the employee felt ill and left work. On April 28, 2021, the employee was hospitalized for treatment for COVID-19. At 7:27 p.m. on May 10, 2021, he died due to the infection. At 8:11 p.m. on May 11, 2021, the employer notified DOSH that the employee had died. This did not meet the reporting requirements. On May 12, 2021, DOSH began an investigation. The employee had been working as a corrections officer in a detention area for detainees who were not COVID-19 positive. He was required to wear an N95 respirator while working. He had declined to be vaccinated against COVID-19. DOSH would not be issuing any accident-related citations.
