Employee with COVID-19 infection dies

On January 7, 2021, Employee #1 who had been working as a Licensed Practical Nurse (LPN) providing direct patient care at a rehabilitation and health care center started exhibiting COVID-19 related symptoms. Employee #1 was confirmed to have been exposed to COVID-19. Employee #1 was hospitalized 5 days later and died due to COVID-19 related complications on February 3, 2021. The employer provided N95 respirators and established several administrative controls (social distancing, employee and patient testing) in an attempt to control the spread of COVID-19. Employee #1 worked a double shift with three residents who had tested positive for COVID-19 following her shifts. COVID-19 positive residents were isolated in their private rooms and staff conducting work inside the rooms were provided and required to wear Personal Protective Equipment (PPE) such as gloves, gowns, eye protection, and N95 respirators. Signage was provided to instruct employees of positive COVID-19 residents and the required PPE. Staff were required social distance during shifts including breaks and while at workstations. However, the employer failed to fit test employees or obtain respirator medical clearance from a physician or other licensed health care professional (PLHCP).
