Investigation Summary
An employee was working as a certified nursing assistant (CNA) in a nursing care or skilled nursing facility. He was required to provide care and treatment to residents with active COVID-19 infections. He contracted COVID-19 in the workplace. On November 27, 2020, he tested positive during routine testing. He was out of work until December 11, 2020, when he died. The employer learned that the employee had died via voicemail from the next of kin on December 15, 2020. The employer did not report the fatality to OSHA until January 20, 2021. During a conference, the employer's human resources person said that she and the employer's administrator attempted to report the fatality online via OSHA's website on December 18, 2020, three days after learning about the fatality. They put in the county and ZIP code and filled in each field, but the website stated that a required field was blank. They stated the website would not let them continue to the next step.
