One employee with COVID-19 infection dies and one employee i

In April 2020, there was a small outbreak of COVID-19 in the workplace, a nursing facility. There was a larger outbreak in June of 2020. Employee # 1 and Employee # 2 worked directly with patients within the facility, in different units. During the outbreak the facility was split into three color coded zones, labeled red, yellow and green, containing confirmed or suspected COVID-19 cases, asymptomatic and untested patients who had not received a negative COVID-19 test result, and confirmed COVID-19 negative residents; respectively. On June 12, 2020, at approximately 10:00p.m., Employee # 1, a Licensed Vocational Nurse, was hospitalized due to COVID-19. The Division was notified on June 16, 2020 at approximately 7:49PM by the Employer, and arrived at the facility on July 9, 2020. On July 14, 2020 at approximately 1:27p.m., Employee # 1 died due to a cardiac arrest caused by COVID-19 and associated conditions. The Division was notified on July 14, 2020 at approximately 6:15p.m. Employee # 1 worked in a "red zone" during the outbreak. Prior to the first detected COVID-19 case Employee # 1 wore a surgical mask while at work, but once COVID-19 cases were detected, Employee # 1 wore an N95 respirator and other personal protective equipment including goggles or face shields, surgical gowns, and gloves. Employee # 1 last worked on June 6, 2020, and tested positive for COVID-19 on June 8, 2020. On June 20, 2020, at approximately 2:00p.m., Employee# 2, a Certified Nursing Assistant, was hospitalized due to COVID-19. The division was notified on June 20, 2020 at approximately 2:04p.m. by the employer, and arrived at the facility on July 9, 2020. Employee # 2 worked in a "green zone." At the beginning of the outbreak, employees working in the green zones work surgical masks but not N95 respirators. Employee # 2 last worked on June 13, 2020; tested COVID-19 positive on June17, 2020.
