Investigation Summary
At 11:45 a.m. on May 4, 2020, Employee #1 and a Coworker, employed by a construction company, were working at a heavy construction project. Employee #1, wishing to speak with his coworker, drove a Polaris General 1000 ATV and parked it 10 to 15 feet from a moving Hitachi ZX350LC-6N excavator being operated by the coworker. The coworker was unable to stop the excavator due to a spray can that had become jammed behind the left travel lever and accelerator pedal. The excavator struck and ran over the ATV's driver side. Employee #1 sustained crushing injuries and was killed.
