Investigation Summary

Investigation Nr: 125356.015
Event: 04/12/2020
Employee with COVID-19 infection dies

An employee was working at an assisted living facility for the elderly. She was taking care of patients both at their homes and inside a skilled nursing facility where infected patients were being treated. On March 22 and March 29, 2020, she provided home health services to a client in the client's private residence. On March 18, March 19, and March 20, 2020, she worked in a skilled nursing facility operated by her employer. She did not have a medical evaluation for an N95 respirator. At some point, she was exposed to COVID-19. It was not clear whether she was hospitalized. She died at 8:00 a.m. on April 12, 2020. This was an OSHA-covered fatality. An investigation found that the employer's workers were exposed to exacerbation of pre-existing cardio pulmonary conditions. The safety and health inspector learned through employee interviews and a review of documents that the employer did not have a provision or procedures for medical evaluation in the written respiratory program. The employer provided and mandated employees to wear N95 Respirator when working with COVID-19 positive patients.
