Investigation Summary
At 3:55 or 4:00 p.m. on November 15, 2018, an employee was working for a landscaping service and arborist. He was working in the front yard of a residential property. His employer had been contracted to trim Brazilian pepper trees in the front yard. The employee had a supervisor present. The supervisor was a foreman and lead man. The employee climbed into a tree on the right side of a driveway to trim it. He was using a tree worker's saddle and lanyard to trim tree branches with a pole pruning tool. The employee was approximately 4.6 to 5.8 meters (15 to 19 feet) high in the tree. The branch that the employee was tied off to broke. He fell to the ground. He sustained a fractured right arm and spinal damage, causing limb paralysis. He was admitted to and treated in the Orange County Global Medical Center (California) and hospitalized over 24 hours for other treatment. The Huntington Beach Fire department called DOSH at 4:17 p.m. that same day to report the incident. A foreman, acting as the employer's representative, called DOSH at 2:54 p.m. the following day to report the incident. This met the employer's reporting obligation. DOSH arrived on the site at approximately 10:00 a.m. on November 16, 2018. An accident related violation was determined - 3427(a)(1)(C)(4) - serious. The factor that caused the incident was an incorrect anchorage of the rope. If the employee had been tied off to the main leader or a major upright branch, it would not have not broken.
