Investigation Summary
At 11:20 p.m. on August 23, 2018, an employee was working for a firm that provided refrigerated warehousing and storage. The site was a fixed location, a warehouse. The employee was employed as a permanent full-time employee at the time of the incident. He had an immediate supervisor. The employee and a coworker were transferring a load from a trailer at gate 109 to a trailer at gate 108. The employee was in the trailer at gate 109 to get the information on the trailer and give it to a clerk. The dock ramp for gate 109 was in a vertical position. A mechanic had worked on it few hours before. The employee's coworker was at the control of the dock ramp for the trailer at gate 109. He did not see the employee in the trailer. He lowered the ramp from its vertical position. As he lowered the ramp, it came down quickly. The coworker tried to warn the employee, but it was too late. The ramp struck the employee on his left foot and ankle. The employee suffered multiple fractures in his left foot and ankle. He was taken to Riverside Community Hospital, where he was hospitalized for four days. The firm's safety manager reported the injury to the San Bernardino District Office at 10:37 a.m. on August 24, 2018. The employer met the Division's reporting requirements. A CSHO from the District office arrived at the work site and opened an investigation with another member of management at 2:00 p.m. on August 28, 2018. The mechanic stated, either during the investigation or earlier, that he did not test the dock ramp by lowering it and raising after the repair and that he had left the ramp in its vertical position. Testing of the function would have prevented the incident. One accident related violation was cited: T8CCR 3328(g).
