Employee is injured in fall from makeshift ladder

At 3:00 p.m. on April 25, 2018, Employee #1, employed by a construction company, was working at a residential home remodeling project. As he climbed a makeshift ladder to assist coworkers, the ladder slipped and fell, and the employee fell on top of the ladder on a concrete surface slab. Employee #1 was transported to the hospital, where he was treated for abrasions, contusions, and a head concussion. The jobsite was a residential home remodeling construction project. This employer has a CSLB class B license, a General Contractor. Employer does not have a C-39 roofing contractors license. A foreman and 2 laborers were involved in demolishing the fascia board around the residential home from the roof. Just before the incident, the injured was climbing the makeshift ladder to assist his coworker measure from the roof the fascia board on the side of the house. The fall from the makeshift ladder occurred about 3:00 pm on 4-25-18. DOSH was notified by emergency responders the same day at 4:48 p.m. Because DOSH arrived onsite on 4-26-18 about 10:30 a.m., employer satisfied reporting requirements. The injured was an employee of Tuan Thai, Homaz Builders and the injured was assigned to do the work by his foreman/lead Alfredo Chavez. Mr. Chavez was present at the backyard worksite since about 8:30 am to 3:00 pm when the accident occurred. As the injured was climbing close to the top of the makeshift ladder towards the residential roof, the ladder slipped and he fell on top of the makeshift ladder onto the concrete slab below, with various impalement hazards, steel bolts and metal stake, in close proximity about 1-2 feet away. This accident could have been prevented if the foreman/lead and the two laborers had been trained in compliance with Title 8 CCR requirements and the employer, Homaz Builders, had provided appropriate equipment, namely the proper selection ladder that was restricted for its use.
