Employee falls from ladder and is killed

At 9:57 p.m. on January 31, 2018, an employee was working for a full-service restaurant. He was a 40-year-old male. He had been providing services to the employer for several years. The employer had made an oral contract with employee to pay him $250.00 to clean the restaurants vents, light fixtures, and ceiling fans. The employee arrived at site between 8:00 p.m. and 9:00 p.m. and met with the owner. He was cleaning HVAC vents and filters. He was working off an aluminum tripod ladder. He set up his personal ladder in the dining room area. He ascended the ladder and removed the cover for the air conditioner system. He threw the cover down to a coworker standing near the ladder on the floor below. As the employee stood on the top step of the ladder, the ladder gave way. The employee fell onto a wooden bench and then the concrete floor below. The coworker called emergency services, and other workers responded to the scene. The employee sustained blunt force trauma to the head. He was killed. The fire captain of the Salinas Fire Department reported the accident via phone at approximately 10:30 p.m. on January 31, 2018.
