Employee struck by tractor

At approximately 8:00 a.m. on February 11, 2004, the owner of Sereda Contracting, a subcontractor, was working on a worksite overseen by general contractor R.W. Construction. Employee #1, the owner and president of R.W. Construction, was working with his crew cleaning up concrete blocks from a damaged block wall. The subcontractor drove a front end loader-equipped tractor on some broken concrete blocks which were on asphalt. The subcontractor stated he set the parking break, got off the tractor, leaving it running and in gear. He stated he put the shuttle in neutral. When the subcontractor was about 100 feet away from the tractor, it moved forward. At the same time, Employee #1 walked in front of the tractor which knocked him down. Employee #1 was hospitalized for treatment of his broken lower left leg. The tractor, a John Deere Model Number 410B, was owned and operated by a subcontractor.
