Employee breaks four toes when he slips off a ladder

At approximately 1:00 p.m. on March 15, 2000, Employee #1 and two workers were installing a pattern for a sign on a wall. The pattern was being taped to the wall about 12 ft above the ground. Employee #1, using the top half of a 32 ft extension ladder, taped the middle of the sign to the wall. He then moved his ladder in order to tape one end of the pattern. This extension ladder had rubber attached to the feet, but the feet did not swivel, so only a percentage of the rubber feet were in contact with the ground. He shook the ladder, climbed a few steps and shook the ladder again and the ladder seemed to be steady. He climbed the ladder and was using both hands to smooth out the sign when the ladder slipped out from under him causing him to fall approximately 8 ft. The ladder was not tied, blocked, or secured to prevent it from slipping. Employee #1 was hospitalized with four broken toes.
