Employee injured when struck by falling metal gate

At 2:20 p.m., the end of the workday on July 3, 2000, Employee #1, a swingman for the Pervo Paint Company, closed the 20 ft 8 in. by 12 ft 9 in. metal security gate of the shipping department from the outside by pulling it along the railing. He was turning to go into the main building when the gate came off the railing and fell against his back, knocking him to the ground. The Fire Department was called to help remove the gate and Employee #1's was then transported to Martin Luther King Hospital, where he was admitted for three days for treatment of a dislocated right hip and a fractured right knee. Subsequent investigation determined that the gate came off the railing because the 1 1/2 in. by 2 1/2 in. triangular stopper went through the gate's frame instead of catching on it.
