Employee Fractures Foot When Struck by Forklift Mast

On December 8, 2010, Employee #1, a delivery driver, was waiting for a coworker to use a Mitsubishi forklift (Serial Number AF81C- 00096) to load pallets of cardboard boxes into his truck for delivery. The coworker went to pick up three pallets of cardboard boxes and the top pallet fell on the top of the forklift cage. Employee #1 decided to try and remove the pallet from the top of the cage using a Yale forklift (Serial Number A547613), but was not able to remove the pallet. Another coworker came out of the office to help remove the pallet. Employee #1 was then lifted up on a pallet of boxes on the forks of the Mitsubishi forklift by the coworker. When he got to the level of the pallet that was stuck, approximately four feet from the working level, he began kicking the pallet to dislodge it from the mast of the forklift where it was stuck. As Employee #1 kicked the pallet, it broke and the mast suddenly lowered onto his right foot. The coworker then lowered the mast further onto his foot. Contrary to Employee #1's statement, the coworkers stated that he climbed on top of the pallet that was on the forks by himself and tried to dislodge the pallet. The coworkers also stated that they told Employee #1 to get down. Employee #1 had surgery on his right foot and was hospitalized for three days. It should be noted that upon interviews with other workers, it was stated that workers were frequently lifted on pallets on the forks of the forklifts to obtain access to the unguarded elevated storage area (i.e. 106 inches) above the offices. According to the president of the company, workers occasionally access this area for the storage of supplies. It was also noted that Employee #1 stated that he frequently drove the forklifts, although he had not received forklift training from the company.
