Employee injured when fingers cut off by shear press

At 7:00 a.m. on May 18, 2001, a serious injury occurred at MD Enterprises in their Research and Development Department. The employer is engaged in the manufacturing of horse barns. At the time of accident, Employee #1 was operating a shear press made by Basic Machine Tools, Model Number 129X1-8 PS, Serial Number C05028, to cut small pieces, 3-inches by 4-inches, from a 2-foot long, 3.125-inch wide strip. As the strip got smaller, and while cutting the last piece, Employee #1 had lifted up the guard. The shear press was not equipped with a fixed guard. He pushed the part with his right hand and his left hand was placed very close to the blade. As Employee #1 pushed the foot pedal, the tip of his left index and middle finger got cut off. Employee #1 was hospitalized for treatment of the amputation.
