Employee injured when struck by falling construction debris

On September 5, 2003, Employee #1 and coworkers were involved in renovating a two-story, approximately 24 ft tall building with a parapet, following blueprints submitted by the new tenant. Employee #1 was working for an electrical contractor that installed computer cables and phone lines. He arrived at work at approximately 6:00 a.m., reported to his crew leader for duty, and was assigned to get rid of trash that had piled up the previous day. Employee #1 was approaching one of the trash bins when he was struck on the head and shoulders by falling sections of broken pallets that were being thrown off the roof by a coworker. He suffered facial and shoulder fractures and was transported to the hospital, where he underwent several surgeries and was treated for five days. A general contractor supervised several subcontractors at the job site, but not the coworker who threw the debris off the roof. He worked for a heating and air-conditioning contractor that had been hired by the building owner to replace HVAC units. The general contractor had provided two trash containers for his subcontractors to use; both were located on the same side of the building, approximately 100 ft apart.
