Employee Iamputates Thumb Using Miter Saw

At approximately 10:00 a.m., on October 12, 2005, Employee #1 was operating a miter saw, RYOBI Model Number TS1340, Serial Number N040513812. He was cutting a 4 in. diameter plastic slit pipe. The self retracting telescopic plastic guard had been broken previously, exposing the blade teeth at the lower quadrant closest to the operator's side. As Employee #1 cut the pipe, something happened that caused the plastic guard to further shatter. He was injured, when he contacted an unguarded portion of the saw blade. He was hospitalized for an amputation of his right thumb up to the full nail.
