Employee Is Struck by Steel Beams and Fractures Legs

At approximately 7:15 a.m. on June 16, 2006, a temporary employee was working at Macsteel Service Centers Inc. The employee started working for the company two days before being injured. The storage area was not paved and stacks of metal beams rested on either wood blocks or steel tubes. A forklift operator was operating a Hyster H250HD Forklift (Serial Number G0072E02148C). The operator positioned the forklift facing the stack of beams and was using the left fork of the truck. The employee stood on a stack of four beams located approximately 45 in. to the right of the stack being aligned. While the employee watched the forklift operator make slight adjustments to the beams, a stack of 12 steel beams located behind the employee, collapsed, and pinned his legs. Each beam was 40-ft in length and weighed 1,200 lbs. The stack was approximately 44-in. high. The employee believed that the right fork of the truck struck the 44-in. high stack of beams, while the forklift operator was aligning the other stack with the left fork. The employee was transported to Arrowhead Regional Medical Center in Colton, where he was hospitalized with fractured legs.
