Employee's arm fractured when pinned by boom

At approximately 8:55 a.m. on July 24, 1996, Employee #1, a laborer, chained a manhole section to a backhoe bucket to lower it into an excavation. He then attempted to operate the foot swing controls on the machine from the ground. When he manually depressed the boom swing control pedal, the boom swung abruptly to the right and pinned his right arm and biceps against the tractor. Employee #1 suffered a severe fracture of his right upper arm and was hospitalized for five days.
