Forks of forklift crushed and broke ankle

An employee was working alongside his father and brother at the Fong Ranch picking up scrap metal. All three were self employed. The ranch owner was helping them pick up the heavy pieces with his forklift. The owner stated that the forks had become stuck. The employee decided to try to unstuck the forks by pulling on them while the owner continued to work the gears. The employee stopped and looked up at the forks at the same time they became unstuck and fell onto his right foot and leg. He was hospitalized with a broken right leg. The Fong Ranch was a pear farm but had become dysfunctional over the past three years due to bankruptcy. In addition, the owner did not give him directions to work on the forklift so there was no employee and employer relationship and no violations were found.
