Employee is injured when oak tree falls on him

On June 2, 2003, Employee #1, a timber faller, cut down a fir tree that brushed an oak tree as it fell. Employee #1 trimmed the limbs off the felled fir tree and bucked the felled fir tree into a 16-ft long log and a 40-ft long log. Employee #1 estimated that it took him approximately 15 minutes. Employee #1 set his chain saw on the ground. When he was writing his scale down, recording the amount of timber felled, he saw a moving object out of the corner of his vision. Employee #1 started to move but was knocked to the ground by the falling oak tree. Employee #1's hip and both legs were fractured. He was hospitalized.
