Employee's Back Is Fractured in Fall from Scaffold

At approximately 3:45 a.m. on March 21, 2007, Employee #1, a carpenter, was working on a ceiling. The ceiling was approximately 8.5 ft from the floor. He was kneeling on a fully planked rolling scaffold that belonged to a subcontractor. The rolling scaffold was approximately 3 ft by 10 ft and 5 to 6 ft above the floor. He had removed the guardrails on two sides of the scaffold because they were on his way. He was placing a small piece of wood in the recess area of the ceiling but the piece did not fit. As he pulled down the piece to adjust its size, he lost his balance and fell to the floor on his head. He suffered cervical and an upper back fracture and was hospitalized.
