Employee's back broken in fall with stepladder

Employee #1 was on an 8 ft fiberglass stepladder, masking a 7 ft tall window of a two-story residence having its exterior walls repainted. He was on the fourth or fifth step when the ladder jerked and he fell, landing on his back on top of the ladder. He suffered fractures to his back between the C1 and C12 vertebrae. The accident occurred on Employee #1's fifth day on the job. He was inexperienced and had set up the stepladder without fully locking open the folding cross-braces.
