Investigation Summary
At approximately 3:50 p.m. on March 11, 1997, Employee #1, age 17, of Delta General Construction, was using a hand-held skill saw to cut 10 in. blocks out of 2 by 4 wood pieces. The wood piece moved as he was cutting and the saw kicked back, amputating his right toe. Employee #1 was taken by ambulance to Valley Medical Center, where he underwent surgery to reattach the toe. He remained under observation in the hospital until March 18, 1997, to see if the toe reattachment was successful. During subsequent interviews, Employee #1 said that he had not tied back the guard. He indicated that when the saw kicked back, the piece of wood became caught on the saw guard and jammed it open. The guard was found to be operational during the inspection immediately following the incident. Employee #1, who was working alone at the time of the accident, had five months of on-the-job training under the direction of his foreman. The employer was issued a regulatory violation for failure to report a serious injury to CAL/OSHA.
