Investigation Summary
On June 19, 1996, Employee #1 was next to a curb, picking up traffic cones from a roadway. As he was storing them in the back of a flatbed truck, he was struck by a car and pinned against the truck. Employee #1 suffered a broken neck, spinal cord, and legs; he was killed. Employee #1 was wearing a warning vest, but the driver, who was on his way home from taking the Department of Motor Vehicles Test, had taken prescription drugs that morning, and had either passed out or fallen asleep behind the wheel. Because the accident occurred on a public street and was classified as a motor vehicle accident, Cal/OSHA had no jurisdiction over it. No accident-related citations were issued.
