Employee's leg is injured when nozzle fails

At approximately 2:30 p.m. on October 9, 2003, Employee #1, a Utility Worker with the City of Morgan Hill, and two coworkers, were washing scuff marks off a residential driveway with water using a high pressure hose, pipe and nozzle assembly on a Vactor Truck 166 (Model #2100). According to its UL listing, the Croker adjustable fog nozzle (Model #3462) was rated for 100 psi at a full-open discharge of 54 gpm. According to the Vactor Truck's specifications, 60-80 gpm at 2000-2500 psi can be delivered at the nozzle. After a coworker turned on the water while Employee #1 was holding the hose, a small amount of water began to spray from the nozzle. Employee #1 then began to twist the nozzle to open it further, however the water spray stopped completely. Employee #1 instructed the coworker to shut down the system, and then tossed the nozzle away from him and began to run. While Employee #1 was a few feet from the nozzle, a portion of it separated from the rest of the assembly. The remaining portion of the nozzle, still connected to the hose assembly, struck Employee #1's right thigh and knocked him to the ground. He was hospitalized with an open femur fracture.
