Investigation Summary
Employee #1, a hotel maintenance employee for Grosvenor Properties, Ltd., was working on a thermostat control and a lockable cover plate at the Valley Oak Center/Convention Center. He proceeded to the roof of the structure over the Convention Center area to access and de-energize (turn off) the associated air conditioner units. A portable metal two-step platform had been rolled out of position to the upper level (25 1/2 in. higher) to facilitate repair to a leaking lower level roof. The platform's normal position is within 24 to 28 in. of the roof's edge. Employee #1 did not use the platform as he went to or returned from the air conditioner. A scuff mark on the metal cap on the roof edge parapet wall, approximately 23 1/2 in. from the upper level wall, appears to match the bottom of Employee #1's shoe. It must be assumed that he stepped down from the upper level onto the roof edge parapet wall, lost his balance or slipped, and fell 11 ft 6 in. to the concrete walkway leading to the convention center area. Employee #1 suffered a massive skull fracture and died. Guardrails were not provided along the roof's edge where there is a routine need for employees to approach within 6 ft of the edge. The parapet wall is approximately 5 1/2 in. high; the lower roof level (intermediate level) is approximately 67 in. wide.
