Investigation Summary
At approximately 12:45 p.m. on October 18, 2006, and employee was cutting scrap copper strips into short lengths. He was working with a coworker who left the area to tend to a customer just before the accident happened. The machine was unguarded and the foot treadle control was inoperative. It was the employee's first time using that machine but he had been using a similar alligator shear for three weeks before the accident. The machine involved in the accident had no identifying marks but the other machine was an Enterprise Model Number 216LMC10. The scissor-like blades of the alligator shear were not guarded on either machine at the point of operation to prevent inadvertent entry of hands or fingers. The treadle, foot control button which was connected to the machine was inoperative. Once started, the jaws of this shear moved continuously until stopped by a pushbutton control located to the rear and above the blades. The employee amputated the distal phalanges of two fingers of his left hand, while operating an alligator shear. The employee could not explain how his fingers came in contact with the blades but said that he was probably working too fast. The management was unaware of the need for guarding and assumed that alligator shears without guards was common industry practice. Employees had grown accustomed to using unguarded alligator shears. The employee was hospitalized and treated for his injuries.
