Employee seriously injured in 12 ft fall from balcony

On September 25, 1995, Employee #1, a painter/helper, was checking the plastic sheeting that had been masked to several balconies to ensure that it was still in place after sitting over the weekend. The balconies were at the rear of the house and approximately 3 ft apart. Employee #1 attempted to jump from a big balcony to a small balcony and slipped and fell 12 ft to the ground. He sustained serious injuries and was hospitalized. At the time of the accident, the employer had not installed scaffolding or an access platform so that the employees could safely move from one balcony to the other.
