Employee's hip and leg fractured by falling pallet jack

At approximately 7:30 a.m. on February 28, 2000, Employee #1, of Latino Mercado, Inc., in City of Industry, CA, was in the maintenance area repairing a bent part on a pallet jack that was interfering with the motor and transmission. He raised the pallet jack approximately 24 in. above the ground with a forklift, then started to straighten the bent part by pounding it with a big hammer. After 3 or 4 blows, he heard a noise and saw the pallet jack flipping over and falling toward him. The machine struck his left side and fractured his hip and two bones in his left leg. Employee #1 was taken to Kaiser Hospital, where he underwent surgery and was hospitalized for three days. As of April 6, 2000, he was still seeing a doctor for followup visits. Apparently, Employee #1 did not secure the pallet jack to prevent it from falling off the forklift. The employer was issued a citation for a serious violation of T8 CCR 3650(m).
