Employee's leg fractured in fall through window

At approximately 9:30 a.m. on October 8, 1999, Employee #1, of the Kelley Building Company, was installing metal strips on the exterior of window unit #3 on the third floor of a building. He was standing with one foot on the window sill and the other on a 6 ft A-frame ladder when he lost his balance and fell approximately 23 ft through the 47 in. by 60 in. window opening. He landed near some rebar, fracturing his left leg. He had not been provided, nor was he using, any form of fall protection.
