Investigation Summary
At 5:30 p.m. on September 20, 1996, Employee #1, age 19, was working at an almond processing facility. He was assigned to wrap plastic around the sides of standard size, wooden fruit and nut bins with cardboard lids. The bins were lined up in two rows in the sizer room. A coworker was using a forklift to weigh the full bins on a scale about 20 ft away. As he was backing away from the scale, he looked in his mirror and then around for pedestrians. Employee #1 had just moved from in back of the bin, which was out of the forklift operator's view, to the front of bin. His leg became caught by the forklift's and was fractured. The forklift operator had experience and a training certificate. The employer was cited for a violation of T8CCR 342(a). Employee #1 had worked at the company as a machine operator/helper since August 16, 1996, and forklift driver had received initial training on August 15, 1996.
