EMPLOYEE HOSPITALIZED WHEN STRUCK BY FORKLIFT

AT APPROXIMATELY 11:26 AM ON SEPTEMBER 28, 1994, EMPLOYEE #1 WAS WALKING INSIDE THE FORKLIFT LANE BY THE #3 BAY DOOR, TALKING TO A COWORKER, WHEN A FORKLIFT STRUCK HIM FROM BEHIND AND PUSHED HIM ABOUT 15 FEET AGAINST A BOX OF TENTS. EMPLOYEE #1 THEN WALKED ABOUT 40 FEET, COMPLAINED OF BACK PAIN AND LAY DOWN. HE WAS TAKEN TO SHARP HOSPITAL AND TREATED FOR A CONTUSION ON HIS BACK AND AN AGGRAVATED RIGHT LUMBAR. HE WAS RELEASED LATER THE SAME DAY. THE FORKLIFT THAT STRUCK EMPLOYEE #1 WAS LOADED WITH LARGE BOXES AND WAS TRAVELLING FORWARD AT SLOW SPEED. ACCORDING TO THE EMPLOYER, EMPLOYEE #1 WAS PROPERLY TRAINED AND HAD 10 YEARS OF EXPERIENCE. BOTH EMPLOYEES WERE FOUND TO BE IN VIOLATION OF THE COMPANY'S SAFETY RULES AND WERE GIVEN SOME RETRAINING AND A REPRIMAND. AN ACCIDENT-RELATED VIOLATION WAS DISCOVERED, AND TWO OTHER VIOLATIONS WERE OBSERVED. CITATIONS WERE ISSUED WITH PENALTIES.
