Investigation Summary
On November 1, 1994, Employee #1 was painting on a concrete tilt-up warehouse in Torrance, CA, operated by Princess Cruises. He using a Rusmar Donkee Lift, model #KD25, to reach the upper portions of the 30 ft high southwest corner. The lift was elevated to a height of 15 ft and had an extension with a load limit of 350 lb. The ground on which the lift was operating sloped westward five degrees. Employee #1 could not reach the corner of the building being painted and he attempted to reposition the lift while it was still elevated at 15 ft. Because the ground was sloping and Employee #1 was on the extension, the lift tipped over when he attempted to move the platform, causing both the platform and Employee #1 to fall. He fractured his right femur and sustained facial lacerations, fractures, and contusions. Employee #1 was an unlicensed painting contractor. The paint, tools, and scissor lift were supplied by the employer.
