Employee injured when struck by backing tractor

The employer has two parallel buildings, a retail store and a warehouse. Clerks in retail must quickly fill customer orders. Stockers assist the clerks by retrieving merchandise from the warehouse. The stockers walk from the rear of the retail store to the warehouse via corridors, a dock, a ramp, or stairs through an exit court that is also a two-lane truck unloading and transit area. Employee #1, a stocker, started walking in this area between a dolly hooked to a tractor trailer and another trailer with its landing gear set down. While Employee #1 was traversing the width of the trailer, the truck driver entered his tractor and backed into Employee #1, throwing him into the fifth wheel table of the dolly and simultaneously pushing him under the trailer where the fifth wheel and table meet. The truck driver stopped just short of killing Employee #1 when he heard screams. Suffering spleen damage and broken ribs, Employee #1 was hospitalized for treatment for one to two days and for observation for two or more days.
