Employee's hand injured when caught in chain and sprocket

At approximately 10:30 a.m. on September 24, 1992, Employee #1 was working in the dry end when he saw that the trash parsley that was being dumped off a 13 1/2 feet high conveyor belt into a truck outside the building had piled up in the truck and needed to be raked down. Although this was not his job, he did not have anything else to do. He climbed the ladder into the truck. The trash parsley had piled up over the conveyor end and over the chain and sprocket from the electrical motor that was on top and driving the conveyor. Employee #1, unaware of the chain and sprocket, put his right hand in this area. The guard on the chain and sprocket was off and his hand got caught. Employee #1 broke two fingers and amputated part of his thumb, and was in the hospital for six days. The man whose job it was to rake down the trash parsley stated that the guard was off earlier in the day. No one knew how or when the guard came off.
