Employee injured in fall through roof opening

Employee #1, a gym employee and physical fitness trainer at Gold's Gym, was removing tar paper and metal stripping from around a roof vent that had been removed, leaving an unguarded 2 ft by 2 ft roof opening. Employee #1 fell 15 ft through the opening, sustaining a fractured nose and skull and a concussion. The cause of his fall is unknown by the employee or employer. He was not protected by a safety belt or any other means. Employee was not engaged in his normal duties. The employer was cited with an accident-related violation of 8CCR 1670(a), "approved safety belts shall be worn when work exposes employees to falls in excess of 7 1/2 feet," serious.
